Terms of Service — Starkie Teams

These terms govern an organisation's use of Starkie Teams, the company headshots product operated by Starkie AI, [legal entity name, registered address, VAT number], from Italy. They add to our terms of service, which continue to apply to account use, intellectual property and liability, and they incorporate the Data Processing Addendum. Where a signed order form and these terms disagree, the order form wins.

The service

An administrator creates an organisation, chooses a shared style, and invites people by email or by an open link restricted to your domains. Each person consents, uploads three to eight selfies, and receives around forty generated headshots. Administrators can review photos before delivery, download them individually or as an archive, and optionally have a branded profile picture composited from the chosen headshot.

Credits

One credit covers one member's shoot: their model training and their generated set. Credits are consumed when a member's shoot starts, not when they are invited. If an administrator rejects a set and asks for a retake, that retake is free and does not consume a credit. Prices, credit quantities and invoicing terms are those of your order; completed shoots are not refundable, because the generation cost is incurred as soon as the shoot runs. Credits are for use by your own organisation and cannot be resold.

Your responsibilities

  • Invite only your own employees, contractors and other people connected to your organisation, and only where you have a lawful basis to arrange headshots for them.
  • Do not upload anyone else's photographs, invite people who have not agreed to take part, or use the service to create images of a person without their knowledge.
  • Keep your administrator accounts secure, and remove administrators who leave.
  • Use the generated images for legitimate business purposes. Do not use them to mislead about who someone is, or in a way that would embarrass or harm the person pictured.

We may suspend an organisation that breaches this section, or an individual account we reasonably believe is compromised.

Your role as controller

For your members' data you are the controller and we are your processor. That means you decide who is invited, what the retention period is (between 7 and 90 days, 30 by default), whether the trained model is kept for retakes, and whether photos are reviewed before delivery. You are responsible for telling your people what is happening, for handling their data protection requests, and for making sure your own use of their images is lawful. We handle their explicit consent at upload on your behalf and record it, and we assist you with requests that reach us.

Service levels

We run Starkie Teams on a best-effort basis: there is no uptime commitment, no guaranteed turnaround, and no support response time unless your order says otherwise. Generation depends on a third-party model provider, and results are AI-generated likenesses, not photographs — they vary, and some sets need a retake. If a shoot fails for a technical reason, the credit it reserved is returned to your balance, so a failure never costs you a credit.

Changes

We may change the service and these terms. Material changes to these terms, and any change to our sub-processors, are announced to organisation administrators by email at least 30 days in advance. Continued use after a change takes effect is acceptance of it.

Termination, export and deletion

Either party may terminate on notice. Closing an organisation is not a self-service action: write to privacy@starkie.ai and we close it and delete its data, so the request is recorded and answered. How unused credits are treated on termination is set by your order. Before you leave, download what you need: administrators can export an organisation's photos as an archive. Until the organisation is deleted, retention and deletion continue to run as described in the addendum — selfies and the trained model on the retention schedule, everything else when you or your members delete it.
